1. Acceptance of Terms

By accessing or using the TapMyTag Portal ("Service"), purchasing TapMyTag products, or scanning any TapMyTag NFC tag, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service or TapMyTag products.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and TapMyTag ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Service Description

TapMyTag provides a digital profile management platform that enables users to create, manage, and share information through NFC-enabled physical tags. Our Service includes:

• Web-based portal for profile creation and management
• Physical NFC tags pre-programmed with unique identifiers
• Public profile pages accessible via NFC tag scanning
• Profile templates for various use cases (medical alerts, business cards, emergency contacts, etc.)
• Automatic template assignment based on product purchase
• Analytics and scan tracking
• Customer support and tag management tools

Template Assignment: Each tag is automatically assigned a template based on the product you purchase (e.g., Medical Alert, Business Card, Emergency Backpack, EpiPen User). Template assignments are managed by TapMyTag to ensure appropriate data structures for each use case. While customers cannot change their own template assignments, you may request a template change by contacting support. All template changes are logged for security and audit purposes.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.

3. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You may not share your account credentials with others or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms or show signs of fraudulent activity.

4. Tag Ownership and Usage Rights

When you purchase a TapMyTag product, you acquire ownership of the physical tag but not the underlying technology, software, or portal infrastructure. Specifically:

• Physical Tag: You own the physical NFC tag and may use it for its intended purpose
• Portal Access: You are granted a limited, non-exclusive, non-transferable license to use the TapMyTag Portal to manage your tag profiles
• Unique Identifier: Each tag is assigned a unique identifier that remains associated with our system and cannot be reprogrammed to use third-party platforms
• Profile Data: You retain ownership of the content you upload to your profiles, but grant us a license to store, display, and transmit this data as necessary to provide the Service

Tags may be transferred to other users through the portal's transfer feature, subject to these Terms. The recipient must have an active TapMyTag account to receive transferred tags.

5. Authorized Use and Infrastructure Protection

The TapMyTag Portal and infrastructure are proprietary systems designed exclusively for use with officially purchased TapMyTag products. You agree that:

• Only tags purchased directly from TapMyTag or authorized resellers may be registered on the portal
• You will not attempt to program third-party NFC tags to use our portal infrastructure
• You will not reverse engineer, decompile, or attempt to extract source code from our systems
• You will not use automated systems, bots, or scrapers to access the Service
• You will not attempt to circumvent any security measures or access restrictions
• Public tag profiles are accessible to anyone with the URL to enable emergency response scenarios, but the portal infrastructure and administrative functions are restricted to authorized users

Violation of these provisions may result in immediate termination of your account and legal action to protect our intellectual property and business interests.

6. User Content and Responsibilities

You are solely responsible for all content you upload, publish, or display through the Service ("User Content"). You represent and warrant that:

• You own or have the necessary rights to all User Content
• Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
• Your User Content is accurate and not misleading
• Your User Content complies with all applicable laws and regulations

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice. We are not responsible for monitoring or reviewing User Content but may do so at our discretion.

7. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Prohibited activities include but are not limited to:

• Uploading false, misleading, or fraudulent information
• Impersonating another person or entity
• Harassing, threatening, or defaming others
• Uploading malicious code, viruses, or harmful software
• Attempting to gain unauthorized access to our systems or other users' accounts
• Using the Service to distribute spam or unsolicited communications
• Violating any applicable laws, including data protection and privacy laws
• Interfering with or disrupting the Service or servers
• Collecting or harvesting personal information from other users

8. Medical Alert Tags - Important Disclaimer

For users of medical alert tags, please note the following critical information:

• Not a Medical Device: TapMyTag products are information storage and display tools, not medical devices. They have not been evaluated or approved by any medical regulatory authority
• Emergency Services: Do not rely solely on TapMyTag for emergency medical communication. Always carry traditional medical identification and inform emergency contacts of your medical conditions
• Accuracy: You are responsible for ensuring all medical information is accurate, current, and complete. Update your profile immediately if your medical status changes
• Technology Limitations: NFC technology requires compatible devices and may not work in all situations. Internet connectivity is required to view profile information
• No Guarantee: We cannot guarantee that emergency responders will scan your tag or have access to compatible technology

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

• Profile information you choose to make public will be visible to anyone who scans your tag
• We collect analytics data about tag scans, including location and device information
• We comply with GDPR and other applicable data protection regulations
• You have the right to access, correct, or delete your personal data
• We implement appropriate security measures to protect your data

10. Intellectual Property Rights

All intellectual property rights in the Service, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by or licensed to TapMyTag. These Terms do not grant you any rights to our intellectual property except as expressly stated.

The TapMyTag name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TapMyTag. You may not use these marks without our prior written permission.

You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

11. Payment and Refunds

Prices for TapMyTag products and services are as stated on our website or through authorized resellers. Payment terms:

• All prices are in Euro (€) unless otherwise stated
• Payment is required at the time of purchase
• We accept payment methods as displayed during checkout
• Prices are subject to change without notice

Refund Policy: Physical products may be returned within 14 days of receipt if unused and in original packaging, subject to our Return Policy. Digital services and activated tags are non-refundable. Defective products will be replaced at no charge.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPMYTAG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
• Failure of emergency responders to scan or access your medical alert tag
• Inaccuracy of information displayed on profiles

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or €100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless TapMyTag, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• Your profile data may be deleted after a grace period
• Physical tags will cease to function as intended
• You remain liable for any outstanding obligations

You may terminate your account at any time by contacting customer support. Termination does not affect any rights or obligations that accrued prior to termination.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute in good faith within 30 days.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on our website
• Updating the "Last updated" date at the top of this document
• Sending an email notification to registered users (for significant changes)

Your continued use of the Service after any modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
